Sensation in the trial against Michael Jackson. It seems that the defending lawyers of the King of the Pop one have signed a motion it turns to Rodney Melville, the Judge of the Superior Court of Santa Barbara entrusted of to instruct the case-Jackson. It deals with an invitation to close the trial cancelling the formal action of accusation related to the accused Jackson. The motive? A long series of abuses committed by the Proxy, first among the whole pressure practiced on the key witness of this trial, her-presumed-victim of the nuisances of the singer. According to the defense, the accusation would like to cover with sand a test a ribbon recovered to his time by a private investigator that answers to the name of Brad Miller,: it would deal with a containing recording a declaration of Gavin Arvizio, the victim note, that clarifies to never have suffered abuses from the accused. it Gets her would not have looked for only him to escape the cassette to the availability of the legal ones of the black superstar-and therefore of the jurors that will decide the fates of it - but He would also have forced the small Gavin to compile a document in which the opposite one is declared. More. The motion seriously speaks of incorrect behaviors, of insinuations, of facing sarcasm to ridicule the accused and its staff and of numerous false footsteps of the Proxy of Santa Barbara that they would put in discussion of it the good faith. Val the punishment to remember that the heads of charge to load of King Micheal are serious, that if if its guilt the canatnte was shown it would risk to pass the rest of its life behind the bars and that Judge Melville, that to try to collide with the interference of the media and the privacy of the heads has sent forth the gag to the parts, has admitted already that the right of Mr. Jackson to an equitable trial is not quite guaranteed www.105.net/Members/editore_105/1089278398346/News_view

LOS ANGELES - Michael Jackson's lawyers want the child sex case against him tossed because the prosecutor "bullied" witnesses and allowed the mom of Jackson's young accuser to call the pop star "the devil" in front of the grand jury that indicted him. In a heavily censored court document released Wednesday, Jackson's lawyers described Santa Barbara County District Attorney Tom Sneddon's conduct before the grand jury as "an outrageous display of power that would not be allowed before a judge in any open court." Jackson, 45, is charged with plying the accuser, then a 13-year-old cancer patient, with booze, molesting him and conspiring to imprison the boy and his family at Neverland Ranch to keep them quiet. Jackson denies all charges. Santa Maria Superior Court Judge Rodney Melville sealed 80 pages of the defense's 127-page motion to dismiss the indictment. He released just 47 pages, with witness names, places and other information blacked out. The released pages do not describe the alleged acts of sex abuse or refer to any testimony about them. But the pages offer the first glimpse of Sneddon's starring role in the closed-door grand jury proceeding. The prosecution's response to the defense charges remained under complete seal Wednesday. Lawyers will argue the issue in court Friday. During the grand jury proceeding last March, Sneddon personally questioned the accuser's 37-year-old mother, reportedly a born-again Christian, as she referred to Jackson as "the Devil" and said she didn't want to take "the Devil's money," the document states. The defense labeled the mom's remarks "prejudicial" and blasted Sneddon for doing nothing to tone her down. "(Sneddon) made no effort to stop or limit the harmful impact of this inadmissible testimony," the defense lawyers wrote. Sneddon also "bullied and argued with" the accuser's father and his lawyer Russell Halpern, who had made public statements questioning the mother's credibility, the defense said. In one grand jury exchange with Halpern, Sneddon declared, "That is a total - that is not the way the conversation went and you know it!" In another exchange with the accuser's dad, Sneddon sarcastically hissed: "All right. You got half the question. It's not bad. That'll get you in the Hall of Fame in baseball." © 2004, New York Daily News
